These terms cover npdestracker.com, the public marketing website, and provide a plain-language overview of how the NPDESTracker application is intended to be used. Contractual terms of an annual deployment are governed by separate customer agreements. This page is written plainly and kept short on purpose.

This is the marketing site for NPDESTracker. It describes the product. It is not the application itself, and it is not a legally binding offer of service.
The contractual terms of an annual NPDESTracker deployment are covered by separate customer agreements with your agency. The sections on this page about the application are an overview, not a contract. If you submit a form or email us, we treat what you send as a business inquiry and respond accordingly.
The sections below say the same thing more carefully. If anything is unclear, email admin@npdestracker.com.

Wood Technologies LLC operates NPDESTracker. References to NPDESTracker on this site refer to the product and platform operated by Wood Technologies LLC.

Pages on this site are not a legally binding offer of service, a substitute for legal or compliance advice, and are not a representation that the software will meet any specific agency's regulatory requirements. Actual use of the NPDESTracker application is governed by separate customer agreements between Wood Technologies LLC, which operates NPDESTracker, and the customer agency.

We do our best to keep the site available and its content accurate, but we don't promise uninterrupted access. The site may be unavailable occasionally for maintenance, upgrades, hosting-provider outages, or reasons outside our control.
Content on the site may be updated, corrected, or removed at any time without notice.

Screenshots and product visuals on this site depict the NPDESTracker application. Some visuals may use illustrative data for readability. Actual product behavior in a customer environment may differ.

When you email us about a pilot, an annual deployment, or a general question, you're sending a business inquiry. We use what you send to respond, coordinate next steps, and follow up, as described in our Privacy policy.
Please don't include confidential, sensitive, or regulated information in unsolicited email. If you need to share material that's confidential, mention that in your initial message and we'll set up a more appropriate channel.

This site may link to third-party services. For example, the NPDESTracker application at app.npdestracker.com, email providers, or reference material from regulatory bodies. Those services have their own terms and privacy practices.
We are not responsible for the content, behavior, availability, or practices of third-party services you reach through links on this site.
07 · Use of the application
Use of the application
The NPDESTracker application is a compliance documentation tool for municipal MS4 programs. It helps customers track required activities, organize inspection evidence, identify missing work, and prepare annual report documentation.
Customers remain responsible for final review of records, decisions about whether work meets permit requirements, and submission of the annual report to the permitting agency through the agency's submission channel. NPDESTracker does not submit reports on a customer's behalf and does not determine whether a record satisfies a regulatory requirement.
The application is not a substitute for legal, regulatory, or compliance advice. Customers should consult their own legal counsel and permit-issuing agency for definitive interpretation of permit requirements.
08 · Smart Draft is assistive, not authoritative
Smart Draft is assistive, not authoritative
Smart Draft is an assistive feature inside the Annual Reporting workspace. It generates a starting-point draft of an answer from linked evidence so a coordinator can review, edit, and accept or discard it.
Smart Draft does not submit annual reports, certify reports, lock reports, or determine compliance status. Every saved answer is a human action, regardless of how the draft was produced.

Acceptable use
When using the website or the application, you agree not to: attempt to access another agency's tenant or records, attempt to bypass authentication or authorization controls, upload malicious content, disrupt service availability, scrape pages at a rate that affects other users, or use the product to violate applicable law.
Customers should not upload Social Security numbers, payment card numbers, health information, or other personally sensitive data into compliance records or attachments. The application is built for municipal compliance documentation, not for sensitive personal data.
10 · Account security responsibilities
Account security responsibilities
Customers are responsible for maintaining the confidentiality of account credentials, for actions taken through their accounts, and for ensuring that staff who access the application have appropriate authorization. We recommend enabling multi-factor authentication where supported and reviewing audit-log entries on a routine cadence.
If you suspect that an account has been compromised or that someone has accessed your tenant without authorization, email admin@npdestracker.com promptly so we can help investigate.
11 · No warranties and limitation of liability
No warranties and limitation of liability
The site is provided on an "as is" and "as available" basis. We make no warranties (express or implied) about the site's accuracy, completeness, availability, fitness for a particular purpose, or non-infringement, beyond what applicable law requires us to provide.
To the extent permitted by law, NPDESTracker and its contributors are not liable for indirect, incidental, consequential, or punitive damages arising from your use of this site.
For clarity: terms governing use of the NPDESTracker application itself are defined in the applicable customer agreement with your agency, not in this document.
12 · Refunds, support model, and order forms for online purchases
Refunds, support model, and order forms for online purchases
Refund policy for online self-service purchases. Online self-service plans (Guided Pilot, Small MS4 Essentials, and Inspection Starter) include a 30-day satisfaction guarantee. If NPDESTracker is not a fit, email admin@npdestracker.com within 30 days of purchase to request a refund. Refunds may be limited or unavailable after paid setup, bulk data import, custom configuration, custom implementation, or substantial production use has begun. Refunds are issued to the original payment method through Stripe.
Refund policy for quoted plans and pilots. Full Municipality Pilot, Inspection Team, and Full MS4 Platform follow the refund terms in their order form or invoice. Where an order form is silent, the same 30-day standard applies on a best-efforts basis; the order form controls if it differs.
Support model. Online self-service plans (Guided Pilot, Small MS4 Essentials, and Inspection Starter) include email and ticket support during US business hours. Phone-line support, scheduled live meetings, done-for-you configuration, bulk data migration, custom implementation, and custom engineering are not included by default; they are available separately or under a short order form. We do not offer 24/7 support on any tier. Full Municipality Pilot includes a founder-led kickoff. Inspection Team and Full MS4 Platform may include more guided onboarding as listed in the applicable order form or invoice.
Contract, purchase order, W-9, and order forms. Small online plans can be purchased by card or ACH through Stripe. Municipalities that need a purchase order, invoice, W-9, or short order form can request one before payment by emailing admin@npdestracker.com. Larger plans and pilots are issued under a short order form attached to the invoice that lists which guided-setup or done-for-you items, if any, are included. The order form controls in case of conflict with general statements on this site.
Annual subscriptions and renewal. Annual subscriptions do not auto-renew. We email a renewal invoice 30 to 45 days before the anniversary so the agency can decide whether to continue. There is no penalty for non-renewal beyond the loss of workspace access after the subscription period ends; offboarding includes a clean export of records logged during the subscription.

Changes to these terms
If these terms change, we'll update the "Last updated" date at the top, and for material changes do our best to flag them where visitors can notice rather than just quietly update the page.
Continued use of the site after changes means you accept the updated terms.
